TERMS OF SERVICE

Welcome to PINGO. We’re happy to offer you a convenient power bank rental service that will help you keep your devices running anytime, anywhere. Before using the service, please read the following terms carefully.

1. GENERAL PROVISIONS

1.1. Scope of application:

These Terms of Service establish the agreements between the user (“You”) and RENEWECO INVESTMENT JOINT STOCK COMPANY (“PINGO”) regarding the use of PINGO’s platform and services, including the website, mobile application, and charging station system and power bank.

By accessing or using the service, you are deemed to have agreed to these terms and any updates (if any) that are officially announced.

1.2. Updated Terms:

PINGO has the right to adjust and supplement the content of the Terms of Use at any time to be in accordance with internal policies or legal regulations. Users are kindly requested to stay tuned for the latest updates.

1.3. Applicable law:

This Agreement is governed by and construed in accordance with the laws of Vietnam.

2. REGISTER ACCOUNT

2.1. Conditions for registration:

  • You must be at least 18 years old to register and use the account yourself.
  • If you are between the ages of 13 and under 18, you need to obtain consent from your parent or legal guardian before registering and using the PINGO service. Your continued use of the service means that you have obtained the consent of your guardian. You need to provide accurate personal information to register for an account.
  • You need to provide accurate and complete personal information when registering for an account and are responsible for updating it if there are any changes.

2.2. Responsibility for confidentiality:

  • You are responsible for protecting your account and login information.
  • If you suspect that your account has been compromised, notify PINGO immediately.
  • You are solely responsible for all activity that takes place on your account, even if the account is used without your permission, unless it is due to a system error of PINGO.
  • PINGO is not responsible for losses or damages arising from the customer’s failure to protect account information or failure to notify in time when infringement is detected.

2.3. Suspension or termination of the account:

PINGO reserves the right to temporarily block or terminate your account if it detects violations of the regulations, including but not limited to: providing inaccurate information, misusing the service, affecting the system or other users, violating the privacy policy, or abuse of services and promotions. The application of this measure is to ensure the common interests and maintain the
stable operation of the system.

3. INSTRUCTIONS FOR USING THE SERVICE

  • Step 1: Download and install the Pingo app on your phone. Register for an account quickly using your phone number or social media.
  • Step 2: Search for a Charging Station near you through the app or at Pingo’s partner
    locations.
  • Step 3: Scan the QR code on the Charging Station and pay the deposit using a convenient
    payment method.
  • Step 4: Get the Battery and start using it.
  • Step 5: Return the Battery, pay, and withdraw the deposit (if desired).

4. SERVICE PRICE AND PAYMENT

4.1. Battery rental fee:

  • The service fee is applied according to the tariff set by PINGO and published on the website, application or official information channels. The customer’s continued use of the service implies acceptance of the fee at the time of use.
  • To guarantee the use of the service and return the battery, the customer needs to pay a deposit. This deposit will be fully refunded when the battery is returned on time and in accordance with PINGO’s regulations.

4.2. Payment methods:

PINGO provides a variety of flexible payment methods for customers to conveniently use the service, including e-wallets, bank cards, credit cards and other forms as prescribed from time to time. After successful payment, the system will automatically confirm and update the customer’s account on the application.

4.3. E-invoices:

E-invoices will be issued after the transaction is completed, based on the information provided by the customer. In case the customer does not enter the invoice information at the time of payment, the system will automatically use the registered account information to issue the invoice. The Client is solely responsible for the accuracy of the declared information and the registered account information. Any costs incurred (if any) in connection with the adjustment or re-issuance of the invoice will be the responsibility of the customer.

4.4. Promotion policy:

PINGO regularly applies preferential programs for customers. Information about the promotion will be updated on the website, application and official channels. Programs are limited and subject to change according to PINGO’s policies without prior notice.

5. COMPENSATION & REFUND POLICY

5.1. Compensation for loss or damage to batteries:

  • It is the customer’s responsibility to properly store and use the battery during the rental period.
  • In the event that the battery is lost, damaged due to the customer’s fault, or not returned in accordance with regulations, the deposit will not be refunded and the customer may have to compensate according to the current policy.
  • If the problem arises due to a system error or objective cause, PINGO will support appropriate handling without requiring the customer to bear the cost.

5.2. Refund Policy:

  • PINGO commits to fully refund the deposit as soon as the customer completes the return of the battery in accordance with regulations.
  • We are always ready to assist customers in case of questions, transaction errors, or need to review the refund amount – just contact support, the PINGO team will handle it quickly and dedicatedly.
  • The refund period will be carried out according to PINGO’s process, with flexible processing time depending on the payment method to ensure the most convenient for customers.
  • All issues related to refunds or compensation will be handled transparently and fairly based on PINGO’s current policies.

6. INFORMATION SECURITY POLICY

6.1. Commitment to information security:

  • PINGO is committed to protecting customers’ personal information in accordance with appropriate security standards and applicable legal regulations.
  • Details of how personal data is collected, used and protected are set out in the Privacy and Personal Data Protection Policy.

6.2. Client’s responsibilities:

  • Account information protection: Customers are responsible for keeping their login information confidential and not sharing their account with others.
  • Beware of scams: Do not provide personal information, OTP codes, or payment details to anyone outside of PINGO’s official system.
  • Report a violation: If you suspect that your account has been accessed illegally or show signs of fraud, you must immediately contact PINGO support for timely support.

7. LIMITATION OF LIABILITY

PINGO always strives to provide stable service and protect customer interests. However, PINGO is not responsible for damages or losses incurred due to user errors, technical problems beyond its control, or force majeure factors such as natural disasters, epidemics, or legal changes. In case of system maintenance, upgrades or service interruptions, PINGO will notify in time and try to provide appropriate solutions to ensure customer experience.

8. CLAIMS AND DISPUTES

PINGO always wants to bring the best experience to customers and is ready to receive all comments and complaints. In case of disputes, please contact PINGO directly through official channels for timely support. We prioritize resolving disputes through negotiation and dialogue in the spirit of goodwill. If an agreement cannot be reached, the dispute will be handled in accordance with the current law in Vietnam.

9. CHANGE OR TERMINATION OF SERVICE

PINGO may change, update, or suspend the service at any time for system maintenance, policy adjustment, compliance with legal regulations, or for other objective reasons. Any changes will be announced through official channels. Customers may choose to continue using the service to agree to the changes, or stop using it and request to close their account if they do not agree.

USER COMMITMENT

By accessing and using PINGO’s services, you confirm that:

  • You have read, understood and agreed to these Terms of Service, Privacy & Personal Data Protection Policy and related policies officially published on PINGO’s platforms.
  • You commit to comply with the laws of Vietnam and the terms of PINGO when using the service.
  • You use PINGO’s services for the right purpose, do not commit fraud, violate ethics, laws or affect the interests of PINGO and other customers.
  • You are responsible for all activities performed through your account, including the timely payment of service fees and the preservation of PINGO’s equipment during use.
  • You agree that PINGO reserves the right to suspend or terminate your account if it detects a violation of the Terms of Use or signs of abuse of the service.

Your continued use of the service means that you accept all of PINGO’s terms, conditions, and policies from time to time.
